Plot summary
Ann and David Smith share an apartment in New York City, where their quarrels can last for days. One morning Ann wants to know whether David, given the chance to decide again, would still marry her; he says he is happy with her but would not, because marriage cost him his freedom and independence. That day Harry Deever, an Idaho county official acquainted with Ann's family, tells David at his office that a jurisdictional mishap makes the three-year marriage invalid, and brings the same news to Ann and her mother at the apartment. Ann says nothing of it to David, expecting that he will ask her to marry him again. He takes her to the restaurant they once frequented, now rundown, and speaks of no marriage; at home, Ann accuses him of not wanting her and orders him out.

- Alfred Hitchcock's cameo in Mr. & Mrs. Smith, passing Robert Montgomery outside his apartment building while smoking a cigar at 42:58, was directed by Carole Lombard herself, who made him redo his simple part many times to the crew's delight.
- Mr. & Mrs. Smith was the last film released before Carole Lombard's death; her final film, To Be or Not to Be, came out two months after she died in an aircraft crash while on a War Bond tour.
- Hitchcock claimed he made Mr. & Mrs. Smith only as a favor to Carole Lombard, but files at RKO show he actively pursued the project; it was the only pure comedy he made in the United States.
- Mr. & Mrs. Smith was supposed to contain the sound of a toilet flushing, but it was altered to banging pipes instead for reasons of censorship.
- In a 1939 interview, Hitchcock said he wanted to make a film with Carole Lombard in a serious role rather than one of her superficial comedies, believing she could be as good as Paul Muni or Leslie Howard; the result was Mr. and Mrs. Smith.
