Plot summary
Florence and Chet Keefer have a marriage that has given them trouble for years. Their divorce case brings the pair before Judge Anne B. Carroll, who asks them to look back over the life they have shared, in the hope that the marriage might yet be kept. What they tell her is the story of those years, and it comes back in flashbacks. Chet and Florence nearly find fortune more than once, and their arguments keep returning to money. The couple have a son and a daughter, and the shouting between them is frequent and loud.

- George Cukor offered the judge's role in The Marrying Kind to Ina Claire, who had not appeared in a film since 1943. She told him she was not interested in money but would take the part in exchange for a Picasso painting hanging in his office.
- Cukor then suggested former silent-film star Madge Kennedy for the judge; the part gave Kennedy her first feature-film appearance since 1926 and her first in a sound film.
