Plot summary
Andy holds an administrative job at a local women's college in a Massachusetts town, and he and his wife Tracy are newly married and hoping to have children. Money is tight, so when a surgeon named Jed Hill arrives at the local hospital and needs a place to live, Andy, who knew him back in high school, rents him the third floor of the couple's Victorian home. A serial rapist has been attacking women on the campus, and Jed saves the life of a student wounded in one of the assaults. When Tracy is taken to the hospital with severe abdominal pain, Jed is the surgeon who operates.

- Aaron Sorkin refused director Harold Becker's request to write a "steamy" sex scene between Alec Baldwin and Nicole Kidman's characters, saying he had just made a movie with her husband and would not write down what he wanted Kidman to do and hand the pages out to the crew and to her. The scene was filmed without Sorkin.
- Writer Jonas McCord based Malice's plot on a Beverly Hills rumor about a woman and a surgeon who conspired to defraud an insurance company: the surgeon deliberately botched an operation on her so she could sue for $40 million and then split the money.
- Castle Rock Entertainment bought Jonas McCord's pitch, but after working on the script for a time and being unsatisfied with his work, the studio fired him and began looking for another writer.
- Aaron Sorkin's rewrites, written after he finished A Few Good Men, were instrumental in getting Alec Baldwin to agree to star in Malice.
